| Abstract:

For the implementation of allotment of land for the benefit of the community, in this case, the state has a strong legal basis which regulates the allotment of land for the people. This paper discussed the social function of land and the legal protection for people who need access to roads above other people's land rights. By using normative and juridical method combined with legal case studies, the results showed that legal protection for people who need road access over the ownership of land rights of others that causes disputes by making legal settlement efforts through litigation, namely in the Courts and mediation efforts.
